Welcome to Bunny Pools. These Terms & Conditions (“Terms”) govern your use of the Bunny Pools website and your interactions with Bunny Pools, including requests for estimates, appointment scheduling, communications, and pool services.

By accessing our website, submitting a form, requesting an estimate, scheduling an appointment, or purchasing services from Bunny Pools, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. About Bunny Pools

Bunny Pools (“Bunny Pools,” “we,” “us,” or “our”) provides swimming pool cleaning, maintenance, servicing, and related services to residential customers in Orlando and surrounding communities.

Our services may vary based on your location, pool, equipment, service plan, availability, and the scope of work agreed upon with you.

2. Website Use

You may use this website for lawful purposes and for learning about or requesting Bunny Pools services.

You agree not to:

- Use the website for unlawful purposes

- Submit false or misleading information

- Attempt to interfere with the operation or security of the website

- Access systems or information that you are not authorized to access

- Copy, reproduce, or misuse Bunny Pools' content, branding, images, or materials without permission

- Use automated methods to improperly access or collect information from the website

We reserve the right to restrict or terminate access to the website if we believe these Terms have been violated.

3. Estimates and Quotes

Requests submitted through our website, by phone, text, email, or other communication channels are requests for information and do not automatically create a service agreement.

Any estimate or quote provided by Bunny Pools is based on the information available to us at the time.

An estimate may change if:

- The condition of the pool differs from information originally provided

- Additional work is requested

- Equipment or property conditions require additional work

- The scope of work changes

- Conditions are discovered that could not reasonably be identified beforehand

A quote becomes binding only when Bunny Pools and the customer agree to the applicable scope of work and pricing.

4. Service Agreements

Before recurring or additional services begin, Bunny Pools may require the customer to accept a separate service agreement, service plan, estimate, proposal, or other written or electronic authorization.

The applicable service agreement will control the specific:

- Services to be provided

- Service frequency

- Pricing

- Billing terms

- Start date

- Cancellation terms

- Additional services

- Other customer-specific terms

If a customer-specific service agreement conflicts with these website Terms, the customer-specific service agreement will control with respect to the services covered by that agreement.

5. Weekly Pool Service

Bunny Pools may provide recurring weekly pool service according to the customer's selected service plan.

Weekly service generally may include services such as:

- Pool surface skimming

- Debris removal

- Brushing

- Cleaning baskets

- Water testing

- Chemical balancing

- Basic equipment inspection

- Other services specifically included in the customer's service plan

The exact services included depend on the customer's selected plan.

Not every pool, property, or service visit will require the same work.

6. Pool Condition and Water Chemistry

Bunny Pools works to maintain pool water within appropriate operating ranges based on the pool's condition, equipment, environment, and service requirements.

However, water chemistry can be affected by factors outside our control, including:

- Heavy rain

- Extreme temperatures

- Pool usage

- Debris

- Landscaping

- Irrigation

- Equipment problems

- Existing chemical conditions

- Lack of circulation

- Algae

- Contamination

- Other environmental conditions

Bunny Pools does not guarantee that a pool will remain perfectly clear or chemically balanced between service visits.

Customers are responsible for notifying Bunny Pools of significant changes in pool use, equipment, water conditions, or other circumstances that could affect service.

7. Existing Pool Conditions

Bunny Pools is not responsible for pre-existing conditions, defects, damage, deterioration, improperly functioning equipment, structural problems, leaks, plumbing problems, electrical issues, or other conditions that existed before our service.

If we identify a condition that may require repair or additional work, we may notify the customer and recommend an appropriate solution.

Additional work may require a separate estimate or authorization.

8. Equipment and Repairs

Routine pool service does not necessarily include repairs, replacement of equipment, plumbing, electrical work, structural repairs, resurfacing, or other construction-related services.

If additional work is required, Bunny Pools may provide a separate estimate.

Bunny Pools will not intentionally perform additional chargeable work without appropriate authorization, except where immediate action is reasonably necessary to protect property or prevent further damage and applicable law permits such action.

9. Access to Property

Customers are responsible for providing Bunny Pools with reasonable access to the pool, pool equipment, gates, and other areas necessary to perform the agreed services.

If our technician cannot access the property because of:

- Locked gates

- Blocked access

- Animals

- Security systems

- Construction

- Unsafe conditions

- Other access restrictions

the scheduled service may be delayed, limited, rescheduled, or subject to applicable service policies.

Customers should notify Bunny Pools of access requirements before service begins.

10. Safety

Bunny Pools may refuse, delay, or discontinue service when conditions present an unreasonable safety risk to our employees, contractors, customers, or others.

Examples may include:

- Aggressive animals

- Unsafe structures

- Hazardous conditions

- Exposed electrical hazards

- Dangerous chemicals

- Unsafe access

- Severe weather

- Other conditions that make service unsafe

We may reschedule service when reasonably necessary for safety.

11. Weather and Uncontrollable Conditions

Pool service may occasionally be affected by circumstances beyond Bunny Pools' reasonable control, including:

- Hurricanes

- Tropical storms

- Severe weather

- Flooding

- Lightning

- Road closures

- Government restrictions

- Utility failures

- Equipment or supply shortages

- Other circumstances outside our reasonable control

When necessary, Bunny Pools may modify, delay, or reschedule service.

We will make reasonable efforts to communicate significant scheduling changes to affected customers.

12. Service Scheduling

Service appointments and recurring service schedules are subject to availability and operational requirements.

A requested service day or time is not guaranteed unless confirmed by Bunny Pools.

For recurring customers, Bunny Pools may establish a regular service day or service window based on route availability.

Service times may occasionally change due to weather, holidays, route changes, staffing, maintenance, or other operational circumstances.

13. Payments and Billing

Customers agree to pay all amounts due under their applicable service agreement or approved estimate.

Recurring customers may be required to maintain a valid payment method on file.

Payments may be processed through third-party payment providers.

If a payment is declined or fails, Bunny Pools may:

- Notify the customer

- Request updated payment information

- Attempt to process the payment again

- Suspend services when permitted by the applicable agreement

- Take other reasonable collection actions permitted by law

Customers are responsible for keeping billing information current.

14. Recurring Services and Automatic Renewal

Some Bunny Pools service plans may continue on a recurring basis until canceled in accordance with the applicable service agreement.

If a service agreement contains an automatic-renewal provision, the renewal terms, cancellation procedure, billing frequency, and applicable notice requirements will be disclosed in the applicable agreement.

Customers may cancel recurring services using the cancellation method provided in their applicable service agreement.

Where Florida law requires specific disclosures or notices concerning automatic renewal, Bunny Pools will provide those disclosures and notices as required. Florida law requires certain automatic-renewal provisions to be clearly and conspicuously disclosed and contains additional notice requirements for certain longer-term automatically renewing service contracts.

15. Cancellation

Customers may cancel services according to the cancellation terms contained in their applicable service agreement.

Cancellation requests may be submitted by the method specified in the customer's agreement.

Any applicable:

- Notice periods

- Outstanding balances

- Scheduled services

- Refund policies

- Cancellation fees, if any

will be governed by the customer's applicable service agreement and applicable law.

Bunny Pools will not impose a cancellation term that is prohibited by applicable law.

16. Additional Services

Services outside the customer's regular service plan may require separate authorization and payment.

Examples may include:

-Green pool cleanup

- Filter cleaning

- Equipment repairs

- Equipment replacement

- Additional maintenance

- Drain and clean services

- Other specialty services

The price and scope of additional services will be communicated before work is performed when reasonably practicable.

17. Customer Responsibilities

Customers agree to:

- Provide accurate contact and property information

- Provide reasonable access to the pool and equipment

- Maintain safe working conditions

- Notify Bunny Pools of known equipment or pool issues

- Maintain required utilities necessary for service

- Keep gates and access areas available

- Pay amounts due on time

- Follow applicable instructions provided by Bunny Pools

- Notify us of changes that may affect service

Failure to meet these responsibilities may affect our ability to perform services.

18. Photos and Service Documentation

Bunny Pools may take photographs or other documentation of the pool, equipment, or service conditions when reasonably necessary to document service, identify problems, communicate with customers, or maintain business records.

We will handle personal information in accordance with our Privacy Policy.

We will not intentionally photograph people in a manner unrelated to providing or documenting our services.

19. Customer Communications

By providing your phone number or email address, you authorize Bunny Pools to contact you regarding services you have requested, including:

- Estimates

- Appointments

- Service scheduling

- Service updates

- Billing

- Customer support

Where applicable, marketing communications will be handled according to applicable consent and opt-out requirements.

You may opt out of marketing communications as described in our Privacy Policy.

20. Third-Party Services

Bunny Pools may use third-party providers for:

- Payment processing

- Customer relationship management

- Scheduling

- Email

- Text messaging

- Website hosting

- Analytics

- Advertising

- Other business operations

Third-party services may have their own terms and privacy policies.

Bunny Pools is not responsible for the independent practices of third-party providers outside our control.

21. Intellectual Property

The Bunny Pools name, logo, branding, website design, written content, photographs, graphics, videos, and other materials made available through the website are owned by or licensed to Bunny Pools unless otherwise stated.

You may not reproduce, modify, distribute, publish, sell, or commercially exploit Bunny Pools materials without our prior written permission.

22. Website Accuracy

We make reasonable efforts to keep the information on our website accurate and current.

However, we do not guarantee that every piece of information on the website will always be complete, accurate, current, or error-free.

Prices, services, availability, service areas, and other information may change without notice.

The website does not replace a customer-specific estimate or service agreement.

23. No Guarantee of Website Availability

We do not guarantee that the website will always be available, uninterrupted, secure, or free of errors.

Website availability may be affected by maintenance, technical issues, internet outages, third-party services, or circumstances outside our control.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Bunny Pools will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services, except to the extent such limitation is prohibited by law.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Bunny Pools and its owners, employees, contractors, and representatives from claims, damages, liabilities, losses, and expenses arising from your:

- Violation of these Terms

- Misuse of the website

- Provision of false or misleading information

- Failure to provide safe or reasonable access to the property

- Unauthorized use of the website

- Violation of applicable law or third-party rights

This provision does not apply to the extent caused by Bunny Pools' own conduct where applicable law prohibits such indemnification.

26. Disputes

We encourage customers to contact Bunny Pools first so that we can attempt to resolve any dispute informally.

If a dispute cannot be resolved informally, the dispute will be handled according to the applicable customer agreement and Florida law.

Nothing in these Terms prevents a consumer from exercising rights that cannot legally be waived.

27. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

28. Changes to These Terms

Bunny Pools may update these Terms from time to time.

When we update them, we will revise the Last Updated date at the top of this page.

Your continued use of the website after an updated version is posted constitutes acceptance of the updated Terms to the extent permitted by law.

29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

30. Entire Agreement

These website Terms, together with our Privacy Policy and any applicable customer-specific service agreement, estimate, proposal, or other written agreement, constitute the applicable agreement between Bunny Pools and the user regarding the matters covered by those documents.

If a customer-specific service agreement conflicts with these website Terms, the customer-specific agreement will control regarding the services and obligations covered by that agreement.
